If Customs authorities conducting an examination of the load at a Customs office en route or in the course of the journey are obliged to break seals and/or remove identifying marks, they shall record the new seals and/or identifying marks on the vouchers of the Carnet used in their country, on the corresponding counterfoils and on the vouchers remaining in the TIR Carnet.

The cover and all vouchers of the Carnet shall bear the endorsement ‘heavy or bulky goods’ in bold letters in English or in French.

Under certain conditions, loading lists may also be used as annexes to the carnet even when there would be enough space in the manifest to enter information on all goods carried.

On 5 July 2012, the Administrative Committee transmitted to the Secretary-General, in accordance with the Article 59(1) and (2) of the TIR Convention, proposals for amendments to Article 6.2 bis and Annex 9 to the text of the Convention, adopted at its 53rd session held in Geneva on 9 February 2012. On 10 July 2012, the Secretary-General issued the Depository Notification C.N.358.2012.TREATIES, communicating that if, by 10 July 2013, none of the Contracting Parties had notified any objections to the amendment proposals, they would enter into force on 10 October 2013.

Provided that it has been accepted by the Customs office of on or before the final date of validity, as provided for in paragraph 1 of this Article, the Carnet shall remain valid until the termination of the TIR operation at the Customs office of destination.

In cases where the goods are placed under another Customs procedure or another system of Customs control, all irregularities that may be committed under that other Customs procedure or system of Customs control shall not be attributed to the Carnet holder as such or any person acting on his behalf.

the carnet number or the reference number of the Russian DKD internal transit document, or the number of the TD1/IM40 declaration of release for home use in Russia;

These amendments were requested by the transport industry and give the possibility to use vehicles or containers with sliding sheets for transport.

regularly receive goods that have been entered for the procedure, or whose customs authorities know that they can meet the obligations under that procedure;

Those authorities shall complete counterfoil No 2 of the TIR carnet and shall ensure that the TIR carnet is returned to the carnet holder or to the person acting on his behalf.

The efforts to be made by the competent authorities to require payment from the person or persons liable shall include, at least, the sending of the claim for payment to the carnet holder, at his address indicated in the carnet, or the person or persons liable, if different, established in accordance with national legislation.

provide the competent bodies of the TIR Convention with full and complete information on the functioning of the TIR system, in particular, but not limited to, timely and well founded information on trends in the number of non-terminated TIR operations, claims lodged, pending, paid or settled without payment that might give rise to concerns with regard to the proper functioning of the system or that could lead to difficulties for the continued operation of its international guarantee system;

Where goods are carried under cover of a carnet in one of the cases referred to in Article 2(2)(b), or cover of an ATA carnet, the declarant may, with a view to proving the Community status of the goods and subject to the provisions of Article 2, clearly enter the symbol “T2L” or “T2LF” in the space reserved for the description of goods together with his signature on all the relevant vouchers of the carnet used before presenting it to the office of departure for endorsement.

Where the carnet or the ATA carnet covers both Community goods and non-Community goods, the two categories of goods shall be shown separately and the symbol “T2L” or “T2LF” shall be entered in such a way that it clearly relates only to the Community goods.

When the customs authorities of the Member State of departure or entry have not received the “arrival advice” message by the time limit within which the goods must be presented at the customs office of destination or exit, or have not received the “control results” message within six days after the “arrival advice” message has been received, those authorities shall consider initiating the enquiry procedure in order to obtain information needed to discharge the operation or, where this is not possible:

The layout of the TIR carnet was adjusted in order to simplify the use of the carnet and to fully cover all data that is required for the transport.

provide the competent bodies of the TIR Convention with statistical data on the number of Carnets distributed to each Contracting Party, broken down by type;

in the case of transport by road, the international road transport carnet issued before the date of entry into force of this Regulation by the customs office in the country of origin or any other appropriate document authenticated by the relevant customs authorities of the country of origin before that date;

At the request of the carnet holder, the authorised consignee shall issue a receipt, certifying the arrival of the goods at the premises of the authorised consignee and containing a reference to the transit accompanying document and the TIR carnet.
